4. No Product or Medical Claims

Clients are solely responsible for ensuring that any requested claims in the script are:

  • truthful

  • substantiated

  • legal in their jurisdiction


We do not create, endorse or approve medical, therapeutic, or unverified product claims.


Examples of prohibited claims include:

  • “cures”, “treats”, “heals”, “eliminates”

  • false weight-loss or unrealistic performance claims

  • any health statements requiring regulatory approval

6. Intellectual Property & Usage Rights

All UGC videos delivered through AuthentiX Media are subject to the following conditions:

  • Usage rights vary by package (Starter / Standard / Premium).

  • Unless explicitly purchased, usage is limited to organic posting only (no paid ads).

  • Commercial and paid advertising usage must be purchased separately.

  • Raw footage is not included unless stated otherwise.

  • Ownership of the video remains with the creator unless a full rights transfer is specified and purchased.


Unauthorized use beyond the purchased rights constitutes copyright infringement.


7. Performance Disclaimer

UGC can support marketing, but results vary significantly depending on:

  • brand offer & product quality

  • ad targeting

  • budget allocation

  • seasonality

  • platform algorithm behavior

  • competition

  • audience fit

8. No Guarantee of Creator Availability

While we maintain a curated roster of creators, we cannot guarantee that a specific creator will be:

  • available

  • able to meet a specific timeline

  • able to complete specialized requests


In such cases, we may recommend alternatives or reschedule the project.


9. Client Responsibility

Clients are fully responsible for:

  • shipping products to the selected creators

  • customs fees, import duties or lost shipments

  • providing clear briefs

  • supplying legally compliant scripts

  • ensuring their own content usage falls within purchased rights

  • reviewing the delivered content within the revision window


Failure to provide materials in time may delay delivery.


10. Limitation of Liability

To the maximum extent permitted by law, Estamax s.r.o. and AuthentiX Media:

  • are not liable for indirect, incidental, or consequential damages

  • are not responsible for business losses resulting from marketing performance

  • are not responsible for lost products sent to creators

  • are not liable for platform (TikTok / Meta / IG) rejection of ads

  • are not liable for delays caused by clients, creators, shipping carriers, or force majeure events


Our total liability shall not exceed the amount paid for the specific project.
